CC does not cancel state of emergency

(ČIA) On procedural grounds, the Constitutional Court of the Czech Republic (CC) rejected the proposal of a group of 35 senators to annul the government's resolution on declaring a state of emergency from February 14, 2021. At the same time, however, CC adds that the government can declare a state of emergency for a maximum of 30 days and the said period can be extended only after the prior consent of the Chamber of Deputies (PSP). It is not possible to choose a different procedure for prolonging the state of emergency. Therefore, without changing the facts on the basis of which the state of emergency was declared, it is not possible for the government to declare a new state of emergency from the moment when the authorized state of emergency ended and the PSP did not agree to its extension.
